NC Times: Judge upholds ballot argument on Mount Soledad proposition (June 10, 2005)Read the article hereAlso read it from soledadnational.com Roger Hedgecock on KOGO 600 had a field day on his radio show, saying that because of the lawsuit brought on by athiest attorney James McElroy, the argument in favor of Proposition A, a judge's order of the altering of the text that will be published today in the voter's ballot pamphlets ended up making a stronger case for voting Yes on saving the cross on Mt. Soledad. Judge William Pate decided to change one word and delete a four-word phrase in the argument favor of turning the site of the Mount Soledad Memorial with its cross into federal property via transfer from the city government. We said earlier that James McElroy, on behalf of plaintiff athiest Philip Paulson, argued that the argument contained false and misleading statements, whatever he means. McElroy also wanted to get the judge to remove the name of Jerry Coleman, one of the authors, from the ballot argument, with the argument that the signature for Coleman arrived past the deadline. The judge refused to back McElroy. McElroy wanted to strike five of the paragraphs of the argument. The judge refused. Phil Thalheimer, Rep. Randy "Duke" Cunningham, Coleman, and radio talk show hosts Rick Roberts and Roger Hedgecock all signed the ballot last month. Here's what the ballot in favor of Proposition A formerly stated: Transferring the property to the federal government is the only way to preserve Mount Soledad so future generations can honor those who have sacrificed to protect the freedoms of this great nation. The judge ordered just one word in the sentence be changed from "only" to "best", thereby, making the case to save the Cross stronger. Roger also reported that McElroy is trying to appeal the decision, but the timing couldn't be more futile. It's simply too late for him to complain. He better quit while he's behind. His lawsuit made it worse for him and his athiest representative Paulson. Hyprocracy is the offical nickname of the ACLU according to Roger. What were the four words that were removed? The phrase "necessitating the land transfer", since it was already duplicative of the point that is made elsewhere, so the Judge struck it so that this paragraph... Rick, Roger, and Three Others Sued! (June 7, 2005)KFMB morning talk show host Rick Robers, KOGO afternoon show host Roger Hedgecock, plus three others are being named as defendants in a lawsuit being brought up by the ACLU over wording that the five parties endorsed the wording that will appear as the argument in favor of Proposition A on July 26, the special election inititave that involves the cross on Mount Soledad."I have absolutely no intention of backing down or compromising in any way, shape, or form, on my position to protect the War Memorial and the Cross atop Mt. Soledad. Those heroes honored on that mountain fought for all of us and gave the ultimate sacrifice. I refuse to bend or waver in holding that piece of ground for them," states Rick Roberts on the 760kfmb.com website. The talk show hosts broke the news Friday that the ACLU is funding a new roadblock lawsuit filed by atheist attorney Jim McElroy representing athiest Philip Paulson. This lawsuit is meant to intimidate and drain funds away from the efforts to keep the cross on Mt. Soledad. McElroy claims that a number of their statements on the ballot are “false and misleading.” Roger Hedgecock stated on his radio show to summarize in a few words that the ACLU is contradicting itself, trying to change the meaning of the First Amendment to a meaning that suits the athiests and other clients of the lawyers representing the ACLU, rather than the freedom of expression the First Amendment really means such as the wording on Proposition A and the views expressed by the three local talk show hosts on the radio. To counter that attack, Rick started a fundraiser with Committee Chair Phil Thalheimer in the KFMB studio. Roger and Mark on Monday held their own fundraiser to raise money to pay for advertising spots that will appear on television and radio. According to 760kfmb.com, over $40,000 was raised. At last count, Roger raised over $11,000 by estimates, though an exact count wasn't mentioned on the broadcast Monday afternoon. The other three signers of the Proposition named in the lawsuit along with Rick and former San Diego mayor Roger are Philip L. Thalheimer, Chairman of San Diegans for the Mt. Soledad National War Memorial; CDR Randy “Duke” Cunningham USN (Retired), United States Congressman, 50th District, California; and Col. Jerry Coleman, USMC (Retired), Hall of Fame Broadcaster, Voice of the Padres. Donations for that cause are being taken by both radio announcers and www.SoledadNational.com.

This is the wording for Proposition A that drove McElroy over the mental edge and he has completely lost his mind. Roger and Rick, call up the men in the white coats and have them take McElroy away in a straitjacket and commit him in a padded room for two months.You can't file a lawsuit against someone just because you disagree with what the proponents for freedom of religious expression worded on a ballot inititiave! Look at what this loony lawyer is basing his lawsuit on...the wording on this inititave such as this! There is absoultely nothing wrong with that statement. Perfectly legal and protected under the First Amendment. And check out this one... The wording is dead-on and tells us exactly what we're voting on, and the ACLU wants them to change it into what kind of wording to confuse the voters into voting another way thinking that they will save the cross when the opposite was true like they did last November? That ballot should have been invalidated because of the confusion and resubmitted with revised language to vote on. Here's the truth about this frivilous lawsuit. It's about misinterpretating the First Amendment into favoring the ACLU instead of freedom of speech to all viewpoints. The ACLU wants the conservatives to be censored because the ACLU disagrees with what they say about religion on the public airwaves. The ACLU wants the wording changed to confuse voters into voting for the opposite of what the meaning of the ballot stands for like it was last year. The ACLU wants to censor opposing viewpoints in contradiction to their creed of standing up for, you guessed it, freedom of speech. For them, it's freedom of speech only if it agrees with them. Roger isn't going to file any lawsuits against the athiests because he disagrees with them, saying it's ridiculous. He supports all of the people's rights to express a view, even those who disagree with him, but he won't try to censor them because they're resorting to frivilous free speech lawsuits. What I find amazingly accurate is that KLSD 1360, the drivel-driven progressive liberal station, is not much of a productive station. Every few minutes I bother to listen, there's always someone criticizing the conservatives or bashing the Republicans, which gets old very fast. Who wants to listen to a one-trick pony such as KLSD with no variety in their lineup of talk show hosts? The former KPOP should have adopted an All Comedy Radio format, but it looks like AM 540 in Tijuana-San Diego, home of the nostalgia format, may in the future be the local home of that kind of entertaining talk instead of 1360, and could be a significant player in the talk-show wars on the AM dial, while the low-rated 1360 could revert back to the former KPOP nostalgia format they abandonded last August. Even Roger is making fun of KLSD's low ratings (a sister Clear Channel station) saying that it's in 23rd place or something like that in the 3-6pm time slot overall. The late Wally George on his old KLAC 570 talk show (1987-1990) used to have liberals oppose him every week such as Gloria Allred and Larry Rice in a radio debate over various topics of the day, while callers got in on the combat action. Wally also educated the listeners about the dangers of the ACLU and what they stood for back then, and today, it's still true of what they're trying to pull on us free thinkers today. Freedom of speech applies to everybody, not just the liberals.
