The U.S. Third Circuit Court of Appeals in Philadelphia has upheld the ruling that local broadcast stations that simulcast their signals over the Net are subject to pay royalties to record companies the same as internet only stations. The Court also ruled that the broadcast stations would have to keep extensive records and go by rules that govern the amount one artist could be played in a given time period as well as other RIAA rules of programming. NAB Senior Vice President, Corporate Communications Dennis Wharton pointed out that broadcast stations already pay more than $300 million each year to music licensing organizations like ASCAP, BMI and SESAC to compensate songwriters and music publishers and issued this statement, "NAB disagrees with the court opinion, which we believe serves to stifle efforts by hometown radio stations to better serve listeners. We will be exploring all of our legal and legislative options to overturn this decision, which we believe misinterprets the intent of Congress."

Excerpts: Smack in the middle of its 20th anniversary celebration, alternative rock station 91X got the shock of its life last week. A competing station that's barely a year old blew past it in the ratings. According to the summer ratings report from the Arbitron people, 91X is stuck in 18th place. More than 40 percent of its audience has vanished during the past year, with most of the listeners apparently migrating up the dial to FM 94/9. Overall, listeners seem to like 94/9's heavy emphasis on music, its ban on annoying radio chatter and its refreshing refusal to talk over songs. Read more about it at Dotinga's website. Clear Channel's Los Angeles stations are already offering song title and artist information, the radio station's nickname, traffic information and other pertinent information to newer car radios capable of receiving LED read-outs sent via RDS, which uses a station's analog signal to transmit the data. Clear Channel now expands its use of the radio data system to 192 of its radio stations, located in the top 50 markets, by working with Aventura, FL-based Audemat-Aztec in installing RDS generators at Clear Channel stations across the U.S. Clear Channel hopes to have all 192 stations up and running by the end of next month. When asked by R&R how RDS rollout will progress with the impending push to HD Radio implementation by radio stations in the U.S., a Audemat-Aztec spokeswoman said a push is underway to develop RDS for digital radio on a domestic level; the company also offers RDS services to radio stations in Europe broadcasting in digital with the Eureka 147 system.
