RED ALERT: A Call To Action: Save Internet Radio (Live 365 Subscription Letter) (Mar 21, 2002)

As you may have heard, the future of Internet Radio is in danger.

The U.S. Copyright Office is evaluating a proposed royalty rate structure which could price independent webcasters out of existence.

Live365 is actively engaged in protecting the right of the independent webcasters and the Internet Radio community.

Now's the time to write your Congressperson and let them know that YOU know what's at stake if they allow the CARP rates to pass as recommended.

Here's a sample letter. Dear __________________,

I am writing today to express my concern about the recently recommended rates for Internet Radio webcasting.

Following a process set out in the DMCA, three arbitrators appointed by the U.S. Copyright Office submitted a recommendation to the Librarian of Congress that webcasters be charged a royalty for their use of digital sound recordings. If accepted, the rate for webcasters will be seven times higher than that which radio stations pay songwriters for the same performances of the same works.

If the Librarian of Congress does not (a) lower the flat fee and (b) include a percentage-of-revenue alternative, thousands of small webcasters (and many large webcasters) will be silenced.

As a webcaster/listener, I fully support the intentions of the DMCA. Webcasters want to pay a fair royalty. However, if webcasters are forced out of business, I do not believe the royalty rates as proposed will benefit the recording industry or performers when legal music services go under. The winner will be illegal services that promote piracy and do not pay royalties.

I urge you to encourage the Copyright Office to consider your clear legislative intent to allow the use of music in webcasts at a fair royalty rate.

As many of you have already noticed, we've been moving stations over to our system of dynamically assigned IP:Port addresses over the past few months. We expect to complete this process in early April.

Q: How will this affect you and your listeners?

A: Well, your IP:Port is a dynamically assigned resource. It can change between live broadcasting sessions or, for basic and relay mode broadcasts, whenever the listener count goes to zero. All of the Live365 tools, both for listening and broadcasting, handle these dynamic addresses seamlessly. If you are using 3rd party broadcasting tools, however, you will need to look up your IP:Port each time you broadcast. You can find that information on the "Other Tools" page off the Broadcast home page on the site (http://www.live365.com/broadcast/thirdparty.live). If you are using 3rd party listening tools, you should use URLs in the form: http://www.live365.com/play/12345, where "12345" is your station number.

Q: Why are we doing this?

There are two forces behind our decision to move to dynamic IP addresses. First, given our massive number of stations, it's by far the most efficient way for us to service all of our broadcasters' needs. Second, it allows us to provide better up-time for all broadcasters as we can move stations off of overloaded or broken servers, load-balance listener load across multiple machines, and, coming soon, provide ad-free versions of all streams in the service. None of these benefits are available if a station is permanently assigned to a particular IP:Port.
